Privacy Policy

This is the privacy policy of the Australia Japan Business Co-operation Committee ABN 45 621 511 715 of Level 26, 44 Market Street, Sydney (“AJBCC”). All references to “we”, “us” or “the AJBCC” are references to the Australia Japan Business Co-operation Committee.

The AJBCC is committed to protecting your privacy. We adhere to the Privacy Act 1998 (Cth) (the “Privacy Act“) and the Australian Privacy Principles therein. This privacy policy (the “Privacy Policy“) outlines how we will manage any personal information that is disclosed, collected or otherwise handled in connection with the AJBCC website https://ajbcc.com.au/, or any other website owned and operated by the AJBCC (collectively “Websites”).

Personal information we collect and hold
We may collect your personal information in your use of our Websites, including your:

  • contact details, such as your full name, email address, phone number and postcode;
  • company/employment details;
  • transaction information, including details about payments to and from you, and other details of products and services you have purchased from and sold to us;

Unless we have obtained your prior consent, we will not use the personal information that you have submitted to us under this Privacy Policy in any manner which is not consistent with this Privacy Policy.

How we collect and store personal information
We collect personal information in a number of ways, including:

  • directly from you, for example, when you:
    • use or access the Websites;
    • upload information to the Websites;
    • subscribe to receive email updates or other news, services or updates from the Websites;
    • subscribe to receive updates by opting in via mobile phone text message at a function or event held or sponsored by the AJBCC;
    • respond to any surveys or marketing materials carried out by or on behalf of the AJBCC;
    • fill in a contact form on any of our Websites; or
    • as part of the membership process, as we collect personal information relating to our members;
  • indirectly, for example:
    • from third parties such as IT providers who provide services to the AJBCC;
    • from other third parties who provide services through the Websites; or
    • via public sources.

How we hold your personal information
We generally hold personal information in electronic format, which we store either within our own internal systems and applications or using third party data processors and data storage providers.

Why we collect, hold, use and disclose your personal information
The information we collect and store is used for a variety of reasons, including the most common circumstances listed below:

  • to provide our services to you, including our regular email updates or to provide you with new or other information or material that may be of interest to you (however in doing so we comply with all laws relating to spam and unsolicited mail, and you will always have the option to unsubscribe at any time using the opt out mechanism included in our emails);
  • to improve the services which we provide to you, identify which parts of our services and which products we provide are most popular; or
  • to assess the performance of and address problems with our Sites.

Security of Personal Information

We take various measures, depending on the type of information, to ensure the safety of the Personal Information we store. We take reasonable steps to protect Personal Information against loss, interference, misuse, unauthorised access, modification and disclosure. When Personal Information is no longer required we will destroy the information or remove your identity from the information.

Disclosure of personal information
In certain circumstances, we may provide some of your personal information to a third party to assist with the provision of our services.  These third parties may include:

  • IT providers and other technology partners and service providers;
  • lawyers, accountants and professional advisors;
  • agents, contractors or our subsidiaries or other affiliated companies; or
  • law enforcement authorities where we are required to do so by law or pursuant to a legal process.

We also use third party service providers who may store or process your personal information outside of Australia. Unless otherwise advised and to the best of our knowledge, the service providers who we disclose personal information to in this manner are subject to a contract, law or binding scheme that has the effect of protecting the personal information in a way that is at least substantially similar (or better) to the protection offered by the Australian Privacy Principles.

We do not provide your personal information to mailing listing companies.

Access to and correction of your personal information
You can request access to any personal information we hold about you at any time, by contacting our Privacy Officer using the contact details below. Upon your request, we will provide you access to any of your personal information which we hold. If you make such a request, you will be required to provide us with proof of identity. We may charge you the reasonable cost of providing your personal information to you in response to that request.

We may make changes to this Privacy Policy from time to time, by publishing an updated Privacy Policy on our Sites.

These terms govern your use of this website and all related sites owned or operated by the Australia Japan Business Co-operation Committee ABN 45 621 511 715 of Level 26, 44 Market Street, Sydney, (the AJBCC, us, we, our) using commercial web hosting facilities (the Websites). Our Websites include information, tools and links related to our online services and members (together, the Services). By accessing and using the Websites and Services, you agree to comply with these terms and conditions, including our Privacy Policy. The Privacy Policy sets out the personal information we may gather from you through the use of our Websites and the ways in which we may use that information

To the greatest extent possible by law, the AJBCC disclaims any and all liability related to, or arising out of, use of any of the information made available via the Websites.

  • copy, reproduce, recompile, decompile, disassemble, reverse engineer, distribute, publish, display, modify, or create derivative works from any part of the Websites and/or the Services;
  • distribute a computer virus or any malicious code or program that may interfere with the proper working of the Websites; or

Cookies
When visiting our Websites, you do not have to disclose your identity to the AJBCC. However, our Websites may use “cookies” to collect anonymous traffic data from users who access our Websites. Our Websites contain links and mechanics to interface with a number of Third Party Websites, for your information or convenience or to offer additional services. These websites operate independently from our Websites and may be subject to alternative terms of use, including terms concerning use of your personal information. The AJBCC is not responsible for the actions, content and information of third parties, including links to Third Party Websites or advertising by third parties. We have not reviewed these Third Party Websites and we do not control and are not responsible for their content or privacy policies. If you decide to access or interact with any of the Third Party Websites linked on our Websites, you do so at your own risk.

Limitation of liability
To the fullest extent permitted by law, the AJBCC, its affiliated companies and their respective directors, employees, agents and contractors disclaim all representations, guarantees or warranties, express or implied, including, but not limited to:

  • the completeness, accuracy, reliability, suitability or availability with respect to the Websites or the Services;
  • that your access to the Websites will be uninterrupted, secure or error-free;
  • that the Websites and the Services are free of viruses or any other harmful components; and
  • the quality, accuracy, or fitness for purpose of any Third Party Websites or Third Party Material.

To the maximum extent permitted by law, the AJBCC is not liable to you, whether in contract, tort including negligence, statute or otherwise, for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever, whether direct, indirect or consequential, arising out of or in connection to our Websites, any content on this Website, any Third Party Material or services, access (or lack of access) to our Websites by you, or damage caused by a virus or other technologically harmful material that may affect your computer equipment, computer programs, data and proprietary material, however caused.

Nothing in these terms limits, excludes or modifies rights which you may have under any law (including the Competition and Consumer Act) which may not be excluded, restricted or modified by these Terms.

Intellectual Property
Unless otherwise indicated, the AJBCC owns all copyright and all other intellectual property rights in the software, text, graphics, content and design of our Websites. We grant you a non-exclusive and revocable licence to store an instance of the content of the Websites (in an unaltered form) for the sole purpose of viewing it in your use of the Websites.

You acknowledge that the AJBCC owns or is licensed, all copyright in the software, design, text, graphics, and material located on the Websites, including the registered trade mark for the AJBCC logo (“AJBCC Marks”).  Your must not use the AJBCC Marks without our prior written consent, or the prior written consent of the relevant third party. Unless otherwise set out under these terms of use, nothing under these terms of use grants either you or the AJBCC a right to the other’s intellectual property.

Third Party Sites and Software
The Websites may contain links to external websites or applications which are owned or operated by third parties independent of the AJBCC (“Third Party Websites”). Such Third Party Websites include material (including services, systems, information, graphics or data) (“Third Party Material”), which we have not reviewed and for which we accept no responsibility.

Subject to any applicable law which cannot be excluded, the AJBCC makes no warranties or representations:

  1. regarding the accuracy, merchantability, quality, or fitness for purpose of any Third Party Material or products or services made available through the Third Party Websites;
  2. that any Third Party Material does not infringe the intellectual property rights of any person;
  3. that the AJBCC authorises the reproduction of any Third Party Material by linking this Website to the Third Party Material; or
  4. that linking the Website to any Third Party Websites implies any approval or endorsement by us of such Third Party Website, the products or services provided by them, or any association with its operators.

Unless otherwise indicated, software or downloads available via links from the Website are Third Party Material. These products may be subject to a licence agreement between you and the relevant product owner. To the extent permitted by law, we accept no liability in respect of such third party products and we provide no warranty and gives no endorsement in respect of such products or any party connected with them. We do, however, welcome your feedback or suggestions concerning these products.

Communication
While using the Websites and/or the Services you may be given the opportunity to enter or provide information or content (Your Content), including comments and posts across our social media and online communities. The AJBCC is committed to keeping our online communities and conversations respectful. It is a condition of your use of the Websites and/or the Services that you ensure Your Content and any information you provide in relation to your use of the Websites and/or the Services:

  1. is not fraudulent;
  2. does not infringe on any third party’s copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy;
  3. does not violate any law, statute or regulation, and does not constitute or encourage conduct that would constitute a criminal offence;
  4. is not defamatory, libellous, abusive, unlawfully threatening or unlawfully harassing;
  5. is not hateful in language, for example, targeting race, ethnicity, gender, age, colour, or religion;
  6. is not offensive, profane or otherwise contrary to any law; and
  7. does not constitute ‘spam’ or contain any computer viruses or other harmful component.

If any of Your Content contravenes these terms of use it will be deleted, and you may be banned from using the Websites and/or Services without notice to you.

Changes to terms of use
The AJBCC may make changes to these terms of use from time to time and if so, will publish updated terms of use on our Websites. By using the Websites, you are agreeing to be bound by these terms as updated.
